This agreement is a legal document between you (hereinafter referred to as "User" or "you") and 阳新县翔以航电子商务商行 (hereinafter referred to as "we", "us", "our", or "the Company") regarding the use of the "Xiangyihang Collaboration" software and related services. Please read and fully understand each term, especially those that disclaim or limit liability.
1.1 By registering, logging in, accessing, or using the "Xiangyihang Collaboration" software (including web, desktop client, mobile app, etc.), you indicate that you have read, understood, and agreed to be bound by all terms of this agreement. If you do not agree to any part of this agreement, please stop using our services immediately.
1.2 We have the right to modify this agreement from time to time as our business develops or laws and regulations change. The modified agreement will be announced within the platform. Your continued use of the services will be deemed as acceptance of the modified terms. If you do not agree to the changes, you should stop using the services and cancel your account.
2.1 You are required to provide true, accurate, and complete registration information (including email address, mobile phone number, etc.) to complete account registration. You may not impersonate others or use false information.
2.2 You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. If you notice any abnormal activity on your account, please notify us immediately.
2.3 We reserve the right to suspend or terminate accounts that violate laws, regulations, or this agreement.
3.1 We grant you a non-exclusive, non-transferable, non-sublicensable ordinary use license, allowing you to use the Xiangyihang Collaboration software on terminal devices in accordance with this agreement.
3.2 You shall not engage in the following activities:
3.3 We only provide team collaboration tools. The content you store and share through this service is your own responsibility. If it involves infringing upon the legal rights of third parties, you must bear legal liability independently.
4.1 Xiangyihang Collaboration is currently in the beta preview stage. The main features we provide include: HD video conferencing, intelligent channel chat, cloud file collaboration, etc., subject to the actual interface display.
4.2 During the beta period, some features may be unstable. We will do our best to ensure service availability but do not assume absolute responsibility for service interruptions or data loss. We reserve the right to adjust, optimize, or discontinue any feature at any time.
4.3 We may release updated versions to fix defects and enhance performance. You should proactively update to the latest version, as older versions may not receive support.
5.1 The intellectual property rights of text, images, files, and other data that you upload, store, and share through Xiangyihang Collaboration belong to you or the original rights holders. We only provide the technical platform and do not claim ownership of your content.
5.2 To enable proper functioning of the service (such as generating thumbnails, cross-device synchronization, etc.), you grant us a worldwide, royalty-free, non-exclusive license to store, back up, transmit, and display your content. This license automatically terminates after you cancel your account or delete the content.
5.3 We do not actively view or use your private chat and file content unless required by law or necessary to maintain system security.
6.1 During the current beta period, Xiangyihang Collaboration is free for users. If paid versions or value-added services are introduced in the future, we will announce pricing and billing rules in advance.
6.2 Any paid features are voluntary. Paid fees are non-refundable except as required by law.
We value your privacy. Please refer to the Privacy Policy for detailed collection and usage rules. That policy is an integral part of this agreement and has the same legal effect as this agreement.
8.1 To the maximum extent permitted by applicable law, the software is provided "AS IS" without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, etc.
8.2 We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. In the event of service abnormalities caused by force majeure (natural disasters, wars, government actions, power outages, cyber attacks, etc.), we will do our best to restore service but are exempt from liability.
8.3 Under no circumstances shall our total cumulative liability to you exceed the total amount of software service fees paid by you in the past 12 months (if any). For free users, we are not liable for indirect damages, lost profits, etc.
9.1 You may stop using the software and request account cancellation at any time. After cancellation, we will delete your personal information in accordance with the Privacy Policy.
9.2 If you violate the core terms of this agreement (such as infringing on the rights of others or engaging in illegal activities), we have the right to immediately terminate this agreement and block your account.
9.3 After termination of the agreement, you will no longer be able to access the data in your account, and we have no obligation to provide you with data export (unless otherwise required by law).
10.1 The formation, execution, and interpretation of this agreement shall be governed by the laws of the People's Republic of China (excluding conflict of laws rules).
10.2 If any dispute arises out of or in connection with this agreement, the parties shall first attempt to resolve it through friendly negotiations. If negotiation fails, either party has the right to submit the dispute to the people's court with jurisdiction at the defendant's location for litigation resolution.
